Hex Hosting – Terms of Service (TOS)

1. Introduction

These Terms of Service (“Terms”) govern your use of the services provided by Hex Hosting (“we”, “us”, “our”). By purchasing, accessing, or using any of our services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

2. Definitions

Client / You – The individual or business using our services.
Services – Any web hosting, domain registration, email, reseller hosting, or related service offered by us.
Account – The hosting or reseller account you create with us.

3. Account Registration & Responsibility

You must provide accurate contact and billing information.
You are responsible for maintaining the security of your account credentials.
Any activity carried out through your account is your responsibility.
You agree not to share login credentials with unauthorised parties.

4. Acceptable Use Policy (AUP)

You agree not to use our services for:

Hosting illegal content under UK law
Copyright infringement, piracy, or unauthorised media distribution
Malware, viruses, or harmful scripts
SPAM email, mass mailing, or unsolicited marketing
Hosting phishing pages or fraudulent websites
Cryptocurrency mining
Activities that overload or harm server performance (e.g., abusive scripts)

We reserve the right to suspend or terminate accounts violating the AUP.

5. Resource Usage

To maintain quality of service:

Excessive CPU, RAM, entry processes, or IO usage may lead to throttling.
Shared hosting may not be used for file storage, backups, or archives unrelated to your hosted website.
Reseller accounts may not oversell or abuse allocated resources.

6. Payments & Billing

All services must be paid for in advance.
Invoices must be paid by the due date to avoid service interruption.
Failure to pay may result in suspension or termination after a grace period.
All fees are non-refundable unless otherwise stated in our Refund Policy (see below).

7. Refund Policy

Domain purchases are non-refundable once registered.
Hosting accounts may be eligible for a refund within a 14-day money-back guarantee, unless:
- They violate the AUP
- A free domain offer was claimed
- The service has been excessively used or abused

8. Uptime Guarantee

We strive for 99.9% uptime.
This excludes:

Scheduled maintenance
Network issues outside our control
Force majeure events
Client-side configuration problems

Compensation (if applicable) may be provided as account credit only.

9. Backups & Data Responsibility

We may provide backups as a courtesy, but we do not guarantee them.
You are solely responsible for maintaining your own backups.
We are not liable for lost data, accidental deletion, or corruption.

10. Support

We provide support through tickets/email as outlined on our website.
We do not provide coding, website development, or third-party app support unless stated.
Server issues will be handled as quickly as possible.

11. Domains

Domain registrations are subject to the rules of the relevant registry (e.g., Nominet, ICANN).
Failure to renew a domain may result in its loss or additional recovery costs.

12. Suspension & Termination

We may suspend or terminate services if:

You breach these Terms or the AUP
Invoices remain unpaid
The service causes harm to our network
We receive legitimate legal complaints about your content

Serious breaches may result in termination without refund.

13. Liability Limitations

We are not liable for loss of business, revenue, or data resulting from downtime or service interruptions.
Our total liability shall not exceed the amount paid for the service during the previous 12 months.

14. Service Modifications

We may modify pricing, features, or service structure with reasonable notice.

15. Governing Law

These Terms are governed by the laws of England and Wales.
Any disputes shall be handled through UK courts.
