1. Introduction

Welcome to Hex Hosting. By purchasing or using our web hosting and domain registration services, you agree to comply with and be bound by these Terms and Conditions.

2. Services Provided

Hex Hosting provides web hosting and domain registration services to customers located primarily within the United Kingdom. Services are delivered through a reseller hosting platform.

3. Eligibility

Customers entering paid service contracts must be aged 18 or over and able to form a binding contract.

4. Payment and Billing

Payments are currently accepted via PayPal. All payments must be made in full before the activation of any service. Failure to maintain payment may result in suspension or termination of your account.

5. Refund Policy

For eligible initial hosting purchases, we offer a voluntary 14-day money-back guarantee subject to the exclusions explained in our service terms. This guarantee is additional to statutory cancellation rights. Consumers may have a separate 14-day cancellation right for qualifying distance contracts, subject to statutory conditions, including applicable rules where the consumer expressly requests service to start immediately. Domain registration costs may be excluded from our voluntary guarantee, but no provision removes legal rights.

6. Account Responsibilities

Customers are responsible for maintaining the security of their login credentials. Hex Hosting is not liable for any loss resulting from unauthorized access due to customer negligence.

7. Data Collection and Privacy

We collect and process customer information through WHMCS for account management, billing, and communication purposes. Your data is handled in accordance with our Privacy Policy. See our UK GDPR information for further details of your data protection rights.

8. Service Suspension and Termination

We reserve the right to suspend or terminate any account found in violation of these terms or applicable laws.

9. Limitation of Liability

Our responsibility for losses is governed by applicable law and the more detailed service terms. We do not exclude liability for fraud, death or personal injury caused by negligence or other liability that cannot legally be excluded; consumer statutory rights are unaffected.

10. Fair Usage

All hosting services are subject to our Fair Usage Policy, which sets limits on disk usage and acceptable use for multi-website accounts. By using our services, you agree to comply with the Fair Usage Policy.

Each website hosted under a single account is limited to 50GB of disk space.

The total disk allocation for multi-site accounts is the sum of the individual website allocations.

The Fair Usage Policy also defines prohibited usage, enforcement actions, and account management procedures.

11. Governing Law

These Terms are governed by the laws of England and Wales, subject to mandatory consumer protections. Hex Hosting is operated by a UK sole trader trading as Hex UK, with Hex Hosting and Hex Web Design as service brands. The proprietor is Nic Taylor. A business correspondence address is being arranged.
